Terms of Service

1. Purpose and acceptance

These Terms of Service (ToS) govern access to and use of the HEYA platform available at hereyouart.com and via the HEYA mobile app.

By creating an account or using HEYA services, you unreservedly accept these ToS. If you do not accept these terms, please do not use the platform.

2. Registration and account

• Registration is open to any adult natural person or legally constituted organization.
• You are responsible for the confidentiality of your credentials.
• Only one personal account per user is allowed.
• The information provided must be accurate and up to date.
• HEYA reserves the right to suspend or delete any account in case of violation of the ToS.

3. User content

By publishing content on HEYA (texts, images, videos, links), you declare that you are its author or hold the necessary rights for its publication.

You grant HEYA a non-exclusive, worldwide, royalty-free license to display, reproduce and distribute your content as part of the platform's operation. You retain all rights to your content.

4. Prohibited conduct

• Publishing illegal, offensive, discriminatory or harmful content against third parties
• Impersonating another person or organization
• Harassing, threatening or intimidating other members
• Disseminating false or misleading information
• Attempting unauthorized access to HEYA systems
• Using the platform for spam or unauthorized commercial solicitation
• Circumventing security or moderation measures

5. Intellectual property

The HEYA platform, its design, source code and trademarks are the exclusive property of HEYA. No reproduction, modification or distribution is permitted without prior written consent.

6. Liability

HEYA does everything possible to ensure the availability and security of the platform, but cannot guarantee uninterrupted service. HEYA cannot be held responsible for content published by users or for damages resulting from inappropriate use of the platform.

7. Termination

You can delete your account at any time from your profile settings. HEYA may suspend or terminate your access in case of violation of these ToS, with or without notice depending on the severity of the violation.

8. Changes to the ToS

HEYA reserves the right to modify these ToS at any time. Changes take effect upon publication on the platform. By continuing to use HEYA after changes, you accept the new terms.

9. Governing law

These ToS are governed by Belgian law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of the judicial district of Brussels.
